If you make a valid Enduring Power of Guardianship and Enduring Power of Attorney before losing capacity then your family and friends will not have to apply to the State Administrative Tribunal however, it is often the case that people do not make these documents when they have capacity and once you have lost capacity it is too late to make these documents.
Sometimes people have made Enduring Powers of Attorney and Enduring Powers of Guardianship as part of their estate planning but the person appointed under those documents is not acting in the person’s best interest.
